Terms of Service

The agreement between you and Jardinly Live when you use the app or this site.

The short version
Use Jardinly sensibly, keep your account secure, and remember its advice is guidance rather than a guarantee. Your photos stay yours. Subscriptions renew until you cancel, and EU customers get a 14-day withdrawal right.

1. Agreement

By creating an account or using Jardinly Live you accept these Terms. If you do not accept them, do not use the service. Our Privacy Policy forms part of this agreement.

2. Who may use it

You must be at least 16 years old, or the age of digital consent in your country if that is higher. You are responsible for what happens under your account and for keeping your credentials safe. Tell us promptly at support@jardinly.live if you suspect unauthorised use.

3. What the service is — and isn't

Jardinly identifies plants, assesses their condition from what your camera shows, and produces care plans. It is an AI system: it makes mistakes, it works from partial evidence, and lighting, angle or an unusual specimen can change its answer.

Guidance only. Jardinly does not provide professional horticultural, agricultural, veterinary or medical advice, and must never be used to decide whether a plant, berry, leaf or mushroom is safe to eat, touch or use as medicine. For toxicity, allergy or poisoning questions, contact a qualified professional or your local poison-control service.

4. Plans, prices and renewal

Prices include VAT where applicable. Paid plans renew automatically at the end of each period at the then-current price until you cancel; cancel any time before renewal from your account or your app-store subscription settings, and you keep access to the end of the paid period. We will give at least 30 days' notice by email before any price change, and you may cancel instead of accepting it. Purchases made through the Apple App Store or Google Play are also governed by that store's own terms and refund rules.

5. Right of withdrawal and refunds

Consumers in the EU may withdraw from a purchase within 14 days. Where you ask us to start the service immediately and it is fully performed within that window, the withdrawal right ends — we tell you this before you buy. Outside that, write to billing@jardinly.live; we handle refund requests case by case and in line with your local consumer law.

6. Your content

Your photos, recordings and notes remain yours. You grant us a limited, worldwide, royalty-free licence to host, process and display them solely to operate the service for you — and to improve our own models only if you switch that on. You confirm you have the right to capture and upload what you send, including where other people or private property appear in frame.

7. Acceptable use

You may not:

— use Jardinly to identify or cultivate plants whose cultivation is illegal where you are;
— upload content you have no right to, or that is unlawful or abusive;
— scrape, resell, reverse-engineer or automate access to the service;
— attempt to break its safety limits, overload it, or probe its security without permission;
— present its output as professional botanical, medical or safety certification.

8. Our intellectual property

The app, its design, name, logo and underlying software are ours or our licensors'. These Terms grant you a personal, non-exclusive, non-transferable right to use the service — nothing more.

9. Availability

We aim to keep Jardinly running but do not promise uninterrupted service. Features may change, and we may suspend or discontinue parts of the service; where a change materially reduces a paid plan, you may cancel and receive a pro-rata refund for the unused period.

10. Liability

To the extent permitted by law, the service is provided "as is", and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded — including your mandatory statutory rights as a consumer.

11. Termination

You may delete your account at any time. We may suspend or close an account that breaches these Terms or the law, with notice where reasonably possible. On closure your content is deleted as described in the Privacy Policy.

12. Governing law and disputes

These Terms are governed by the law of our place of establishment, without affecting the mandatory consumer protections of your country of residence. EU consumers may also use the European Commission's online dispute-resolution platform. We would rather you wrote to us first: support@jardinly.live.

13. Changes to these Terms

We may update these Terms. For material changes we will notify you at least 30 days in advance; continuing to use the service afterwards means you accept the new version.
